What is Stepparent Adoption?

Stepparent adoption is a process that allows a party to legally adopt their spouse’s child while leaving the spouse’s parental rights intact. Stepparent adoption is often utilized to ensure that a stepparent has the same legal rights and responsibilities as a biological parent. This process can also afford additional important protections to a family, including the right of a child to inherit and to receive certain benefits from a stepparent.

Navigating the Stepparent Adoption Process

In a stepparent adoption, a stepparent must file a petition with the court, including certain supporting documents and information. Depending on the jurisdiction, this may also involve background checks and other requirements. The court will review the petition and all supporting documents to ensure that the adoption is in the best interests of the child and that all legal requirements have been satisfied.

Stepparent adoptions require the consent of both biological parents or the termination of a biological parent’s parental rights. In some cases, the other biological parent may refuse to consent, or the petitioner may be unable to locate the parent. In such situations, the court requires that certain notice be provided with an opportunity to object before a court will proceed with the adoption.
